Court filings reveal that three separate multi-million dollar birth injury lawsuits have been filed against a local hospital in the last few weeks. These lawsuits share a common theme – a lack of communication between staff in the delivery room. In fact, communication failures are the leading cause of injuries to newborns. When labor and delivery problems occur, the result can be brain injuries, injury to the spinal cord, cerebral palsy, mental retardation, autism, and in extreme cases, wrongful death.
If you believe your newborn suffered harm as the result of any form of labor and delivery error, is critical to consult with an experienced California birth injury lawyer right away to begin an investigation into all of the factors that may have affected your child's birth process.
Here, one the medical malpractice suit alleges that doctors failed to recognize and respond in a timely manner to a woman's labor process and that the woman needed a C-Section. Further, once doctors determined the operation was needed, they waited an unreasonable amount of time before performing the procedure. When eventually delivered, the baby was lifeless.
According to the lawsuit, doctors at the hospital delayed bringing the baby back to life, and once they did, not enough staff was available to care for the child. As a result, the boy was critically deprived of oxygen for around 14 minutes, resulting in catastrophic brain injuries including permanent brain damage and cerebral palsy, requiring a lifetime of care, and costing the family almost insurmountable expenses, the lawsuit states.
Two additional birth injury lawsuits are currently pending against the same hospital.
Unfortunately, when communication errors occur during labor and delivery, the results are often devastating. We urge you to contact the dedicated California birth injury attorneys at Bostwick & Peterson immediately if you believe your newborn has suffered harm as the result of medical negligence.
