A jury has just awarded a California family $12.1M in a medical malpractice lawsuit filed against Contra Costa County Health Services. The birth injury lawsuit alleged that the family's son suffered brain damage as the result of negligent care the woman received during her high-risk pregnancy.
If you believe that you or a loved one has been injured as the result of negligent medical care, consulting with an experienced California birth injury law firm is critical to begin an investigation into all of the factors that may have caused or contributed to the harm.
Medical professionals, including doctors, nurses and other health care staff, are held to a certain standard of care. When they fail to act with the requisite medical care required for their job and a patient suffers harm, they may be held liable and responsible to pay damages.
In this instance, the birth injury lawsuit alleged that the mother sought prenatal care for a complicated twin pregnancy and was assigned to a family practitioner who was not qualified to, and did not provide, prenatal care that met the appropriate standard of care. Further, according to the lawsuit the doctor treating the mother allowed the pregnancy to continue too long and failed to respond appropriately when emergency conditions occurred during the pregnancy. Additionally, the mother suffered labor and delivery complications and as the result of a delayed C-section. One of the twins died and the other infant's brain was deprived of blood and oxygen.
As the result of the negligent medical care, the child now has difficulty speaking and has diminished motor skills. He is unable to live independently and will never be able to care for himself or maintain a job.
The jury in medical malpractice lawsuit awarded the boy's family damages for past and future medical care, lost earnings and pain and suffering.
