According to several news sources, a woman who was several injured and traumatized during the delivery of her child, has just recovered $16 million. Following a two week jury trial, the panel determined that the woman’s center where the child was born not only committed medical malpractice by failing to meet the standard of care, but also participated in a reckless misinterpretation of fact through its marketing campaigns which lured the women in.
In the lawsuit, the woman alleged she was forcibly restrained, and was flipped onto her back from her hands and knees as her baby's head emerged. She further asserted that a nurse pushed her baby's head back inside her body for six minutes because the doctor was not yet in the room.
Additionally, evidence revealed that the mother had been seeing a different doctor but had been persuaded to switch based on advertising campaigns and literature showing that the center offered women choices during birth – such as the ability to move during birth – as well as the option to use birthing tubs. However, these promotions were inaccurate. As the result of maltreatment at the center, the mother now suffers from Pudendal Neuralgia – a permanent nerve injury – lives with chronic pain, cannot have sex and cannot have more children.
